These terms apply to your use of the Bihsa app. Bihsa is provided by:

("we", "us").
If you downloaded Bihsa from Apple's App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. These terms add to it. Where the two conflict on the licence to use the app or on Apple's rights, Apple's agreement prevails. Otherwise these terms apply.
If you downloaded Bihsa from Google Play, these terms are the full agreement between you and us. Google Play's own terms govern your relationship with Google, including purchases.
How we handle your data is explained in our Privacy Policy: https://bihsa.com/privacy
Bihsa is an app for mental development through daily practice. It offers learning paths with short exercises, reflections and check-ins across areas such as resilience, self-love, mindfulness, confidence, productivity and creativity, and it shows your progress, for example as a Growth Score.
The Growth Score shows how consistently you practise. It is not a measurement of your health, your personality or your worth.
Bihsa is not a medical product, not a therapy and not a crisis service. It does not diagnose, treat or prevent any illness, and it does not replace advice, diagnosis or treatment by a doctor, psychotherapist or other qualified professional. The content is general and not tailored to your health.
If you have, or think you may have, a mental or physical health condition, talk to a qualified professional. Do not stop or delay treatment because of something in Bihsa.
If you are in crisis or think you might harm yourself or someone else, contact your local emergency number now (112 in the EU, 911 in the USA). In Germany, the TelefonSeelsorge is available around the clock and free of charge at 0800 111 0 111 or 0800 111 0 222. Elsewhere, https://findahelpline.com lists free crisis lines by country.
Some exercises ask you to look at your own thoughts and experiences. If an exercise brings up more than you want to handle alone, you can stop at any time.
You must be at least 16 years old to use Bihsa.
Your account is for you alone. Give accurate information when you create it, keep your sign-in details to yourself, and tell us at hello@bihsa.com if you think someone else has used your account.
To use Bihsa you create an account. When you do, you give your explicit consent that we store your answers in lessons with your account. We ask for it separately because some answers can reveal something about your health. Creating an account requires this consent, because storing your answers is how Bihsa keeps your practice and lets you continue on another device. The details are in §6.6 of the Privacy Policy.
What you write stays yours. You give us only the rights we need to store your answers, show them back to you, and use them inside the app to continue your practice, for as long as your account exists. We do not publish your answers and do not share them with other users.
You can delete your account at any time in the app under Profile → Delete account. This ends your contract with us for the account. It does not cancel a subscription (see §6).
Free and paid parts. Some parts of Bihsa may be free. Full access requires a paid subscription. What is included, the price and the billing period are shown in the app before you buy.
Buying through Apple or Google. You buy a subscription through the App Store or Google Play. Your purchase contract, the payment, and any refund are handled by Apple or Google under their terms. This includes your statutory right of withdrawal as a consumer. We cannot issue refunds ourselves.
Renewal. A subscription renews automatically at the end of each billing period for the same period and at the price shown, unless you cancel it at least 24 hours before the current period ends. Your Apple or Google account is charged within 24 hours before the renewal.
Free trial. If we offer a free trial, its length is shown before you start it. Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription at the price shown.
Cancelling. Cancel in your Apple Account settings (Settings → your name → Subscriptions) or in the Google Play app (your profile picture → Payments & subscriptions → Subscriptions). Your access continues until the end of the period you have paid for. Deleting the app or your Bihsa account does not cancel a subscription.
Price changes. If we change the price of a subscription, Apple or Google tell you in advance and, where the law or their rules require it, ask for your agreement. You can cancel before the new price applies.
Restoring purchases. If you change phones or reinstall Bihsa, sign in with the same account and use "Restore purchases".
Before and around launch, Bihsa may be offered as a free beta, for example through TestFlight. The beta is a version still being developed. It can contain errors, change without notice, lose data in rare cases, or end. Free access during the beta does not create a right to free access after it. Feedback you send us may be used to improve Bihsa without any payment to you.
Please do not:
use Bihsa in a way that breaks the law or the rights of others
try to access other people's accounts or data, or parts of our systems that are not meant for you
copy, extract or redistribute the content of the app in bulk, or use automated tools to do so
interfere with how Bihsa works, for example by overloading it or bypassing the subscription
decompile or reverse engineer the app, except where the law allows it
If you seriously or repeatedly break these rules, we may suspend or close your account (see §12).
The texts, exercises, audio, images, design and software of Bihsa are protected by copyright and other rights, which belong to us or to those who licensed them to us. You may use them in the app for your own, personal and non-commercial purposes. Any other use needs our written permission.
We keep developing Bihsa. We may add, change or remove content and features, as long as this is reasonable for you and the essential parts of a subscription you have paid for remain available. We aim to keep Bihsa available at all times but cannot guarantee it. Maintenance, technical problems or events outside our control can interrupt it.
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
For slight negligence, we are liable only if we breach an essential contractual obligation, meaning an obligation that makes the proper performance of the contract possible in the first place and on which you may regularly rely. In that case our liability is limited to the damage that is typical and foreseeable for this kind of contract. Otherwise we are not liable for slight negligence.
For free use of Bihsa, including the beta, we are liable only for intent and gross negligence, except for injury to life, body or health.
These limits also apply to the personal liability of people working for us.
You can end the contract at any time by deleting your account in the app.
We can end the contract for a free account with two weeks' notice by email. We can end it immediately for good cause, in particular if you seriously or repeatedly break §8. If we end a paid subscription for reasons you are not responsible for, we will help you get a proportionate refund for the unused period.
We may change these terms if the app, the law or the way we provide Bihsa changes. We will tell you about changes in the app before they take effect and ask for your agreement. If you do not agree, the previous terms continue to apply, and both you and we can end the contract under §12.
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you have your habitual residence.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
If any provision of these terms is invalid, the rest remain in force.
You can end the contract at any time by deleting your account in the app.
